Privacy Information

1 Scope, Website Owner and Data Controller

1.1 Scope of Privacy Policy

This privacy policy page informs the visitors of this society website on which personally identifiable information are being collected for which purpose while following the following laws and regulations: German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG), the EU's General Data Protection Regulation (GDPR), and the German Telemedia Act (Telemediengesetz, TMG).

2 Overview on Data Processing

2.1 Scope of Processing Personally Identifiable Data

We are committed to protecting and keeping all personal information you give us confidential within the law and telling you how we use the information we gather about you.
Visiting this website is possible without explicitly telling us any personally identifiable information. Transmission-related data generated while visiting the pages like, for example, your Internet Protocol (IP) address, see section 3.1, are deleted on a regular basis and are never disclosed to third parties, see section below. Using some services on our pages could in the future imply modification of this policy which would then be explained in the sections below. Your personally identifiable information like, for example, your name, address, email address, telephone number, IP address, etc., will only be processed by the society's office within the limits imposed by the current data protection laws and regulations and, with the exception of the weblog files that are generated by the Internet hosting provider, never be stored on the server of the Internet hosting provider. In case you are contacting us by way of email or telephone, your data will not leave our office until being deleted, see details below, and will thus never be dislosed to the web hosting provider or other third parties. Within our privacy policy, personally identifiable data denotes all data that can be used to directly name or track down an individual's identity.
We remark that, due to the nature of the Internet, data transmission is never at all times 100% secure, and that access to data by unauthorized third parties cannot always be prevented: the complete protection of data is impossible.

2.2 Legal Basis for Processing Personally Identifiable Data

The legal basis for processing personally identifiable data in case we are asking the data subjects for their consent is given by article 6(1)(a) of the GDPR.
In case processing is necessary to fullfil legal obligations of the society, the legal basis is given by article 6(1)(c) of the GDPR.
If data processing is necessary due to the lawful interests of our society or those of third parties, and the legitimate interests, fundamental rights and fundamental freedoms of the affected data subject are not exceeding the beforementioned interests, the legal basis for processing is furnished by article 6(1)(f) of the GDPR.

3 Publication of Our Internet Pages (Website) / Generation of Weblog Files

3.1 Acquisition of User Data and Web Logs on our Internet Pages

Our society obtains web log files from the hosting service provider, which contain the following pieces of information transmitted by either the visitor's computer or the visitor's Internet service provider to the society's hosting service provider's server system, which is automatically storing the following info in the web log files while you are invoking one of our pages:
  • browser incl. type/version
  • operating system (if transmitted)
  • referrer URL (previously visited site)
  • Internet protocol (IP) address (hostname) of your PC
  • your provider
  • date and time of server query
  • those of our website pages you visited
None of this information personally identifies you to us and the society does not combine these data with information from other sources. Creation and storage of the web log files is a mandatory step needed by our hosting service provider to make available our web pages on the Internet. There is therefore no way data subjects can object.

3.2 Cookies

The society is not generating any cookies on our website that would necessitate the website visitor's consent. While using SSL encrypted page access (https://..) our web hosting provider transfers auxiliary files, called session cookies, that are technically necessary for the secure https: access before being automatically deleted upon either leaving the page or closing your browser (details may depend on the individual browser used). Session cookies do not contain any data we could evaluate and are not being sent from or to our society but are being exclusively exchanged for technical reasons between you and the web hosting company hosting our domain.

3.3 Legal Basis for Data Processing

The legal basis for temporarily storing data and web log files is given by article 6(1)(f) of the GDPR.

3.4 Transmission to Other Countries

Our website is not sending any information acquired in the European Union (EU) or the European Economic Area (EEA) to a third country outside the European Union (EU) or the European Economic Area (EEA), and the society is furthermore not processing any data subject's data in a third country.

3.5 Purpose of Data Processing

Temporarily storing the IP address by the hosting service provider and the usage of session cookies are required to make available our website to the PC system of those visiting us on the Internet.
We are using the weblog data, acquired and stored by the web hosting provider, just for the following purposes: statistical evaluations; improvement of our website; safeguarding the security of information processing systems used by us and checking the safety and reliability of the hosting service provider. We are never evaluating these data for commercial or marketing purposes and are nver distributing the data to third parties. The owner of the website retains the right, however, to analyze the weblog files should they contain evidence of any illegal activity.

3.6 Social-media Plugins and Tools of other Companies

The society's websites are not using any plugins or tools of other companies to evaluate your visit of our Internet pages. We are not using any social-media buttons, related tools or plugins.

3.7 Remark for Users of Proxy Servers

Using a proxy server instead of directly accessing our pages may occassionally mean that you are being presented not the current version of our websites but older versions that have been cached that is, stored, on the proxy server provider's system. The same may apply if you are accessing cached website versions offered by some Internet search engines. It is possible in those cases that your IP transmission data, otherwise stored in the web log files, is either not being transmitted or being transmitted in an incomplete or modified manner to our web hosting provider's system. Not having any contractual relationship with any of the proxy service providers or search engine companies, the acquisition of data transmitted to these companies and their evaluation of your data is completely outside the scope of our influence.

4 Email Contact Form and Other Email Contact

 

4.1 Description and Scope of Data Processing

Our German-language page on becoming a member contains a contact form visitors may use to contact us or send an inquiry. On our website, the form's data will never be sent to the hosting service provider to subsequently send us an email from there but are instead being kept local on the visitors computer; upon clicking the send button there should be opened an email program locally installed on the visitor's system. The data you entered are thus not stored on our website and there will be no corresponding database entry and no file on our system. As long as you did not install an email program capable of receiving the data you entered in the browser, or if you did not click the send button in your email program, the data visible in the input forms will not be transmitted to us or anyone else but will instead remain on your system. Before sending the email to us, you may edit and correct all data entered into the input forms like name, postal address, email address. subject and message text of the email.
Instead of using the contact form, you may alternatively use the email addresses given on the site info page and the other pages of our domain. In this case our society stores the personal information from your email internally. We are not storing any of the information received on the hosting service providers servers or on any of the web pages.
All data is exclusively used for processing the communication with you. We are never disclosing any data to third parties.

4.2. Legal Basis for Data Processing

The legal basis for processing in case we have received the data subject's consent is given by article 6(1)(a) of the GDPR.
Processing data received in connection with the transmission of an email is done following article 6(1)(f) of the GDPR. In case you initiated the email exchange to enter a contract, processing by our system is also allowed by article 6(1)(b) of the GDPR.

5 Handling of Address Data and Other Personally Identifiable Information

5.1 Personally Identifiable Information

In case you are contacting the society, i.e. the website's owner, your communication will be stored to make possible that we process and respond to your inquiry. Without your consent we will never disclose these data to third parties.
The owner of this website collects and utilizes your personally identifiable information only within the law and if you consented to the acquisition and processing of the data.
Personally identifiable information comprises all information suitable to define or find out who you are, or that may be traced back to you (IP address; email address; name; phone number; postal address; etc.).

5.2 Confidentiality of Information

Upon contacting us by way of email, letter mail, or telephone, we will temporarily store your information to process your inquiry and to be able to respond to subsequent inquiries. The society only keeps your information for as long as it is neccessary, and is regularly reviewing all personal information and archiving, deleting or otherwise removing data no longer needed or considered to be out of date for the purposes in which the society is using data. In case there is a legally imposed retention period, we will delete the corresponding data only after the retention period has ended. To ensure confidentiality, we are never storing personal information on systems provided by our hosting service provider.

5.3 Confidentiality of Donations

Upon receiving donations, your name and account information will also be treated in a strictly confidential manner and are not being combined with other data. Deletion will take place only after the legal retention period has elapsed.

5.4 Legal Retention Periods

Depending on which letters, emails or material containing other pieces of information were transferred to us like, for example, the communication pertaining to financial transactions like donations, we have to observe the legal data retention periods for the corresponding communication, letters, bank account info, etc. In Germany, part of the legal retention periods are defined in paragraph 147(1) und (3) AO (German Fiscal Code), paragraph 257(1) HGB (German Commercial Code) and other German legal codes, and may amount, depending on what to archive, to a total of six resp. ten years after the current year ends.
In case you sent us email or letter mail containing additional personal information that is not connected with the transferral of donations and for which there has not been defined any legally binding archiving period, and you wish that information be erased, you may contact the office in order to have us erase your data in case we still keep them.

6 Data Subject Right: Right of Access, Right of Rectification, Right to Be Forgotten, Right to Object and Right to Complain, etc.

6.1 Right of Access

At any point while we are in possession of or processing your personal data, you, the data subject, have the right to always request a copy of the information that we hold about you. This includes the data proper, their origin, who gets copies of the data, information on their processing and the purpose of storing and processing the data including all other information we might have.

6.2 Right of Rectification, Right to Restriction of Processing, Right to be Forgotten, and Right to Object

In addition to this you have the right to correct data that we hold about you that is inaccurate or incomplete, see article 16 of the GDPR. Following article 18 of the GDPR, you have also a right to restrict the processing of your data where certain conditions apply. As outlined in article 17 of the GDPR, you can ask in certain circumstances for the data we hold about you to be erased from our records. As outlined in article 77 of the GDPR, you have always a right to lodge a complaint directly with the supervisory authority; and always a right to complain with our society. Following article 7(3) of the GDPR, you have a right to widthdraw your consent to process your data at any time. In all those circumstances you may always contact the data controller of our society's web site using the email address info@foerderkreis-kenya-freudenstadt.de or by sending mail to the postal address given in section 1.2 above.
To make possible your request to restrict processing your data, the data have to be transferred to a restricted-processing file. You may also demand to erase the data provided there is no legally defined retention period. In case a legal retention has been defined, we will restrict access to the data following your request.
Following article 21 of the GDPR, you always have the right to object to certain types of processing your data. You may cause future modification of your data or remove your consent by contacting the society using our email address or the address data in section 1.2.

6.3 Right to Complain

As outlined in article 77 of the GDPR, you have always a right to lodge a complaint directly with the supervisory authority; and always a right to complain with our office.

6.4 Additional Topics

In case other legal bodies or other sections of the GDPR are giving you rights in addition to the beforementioned summary, whether this may apply now or in the future, you are always entitled to demand that we keep those rights. To this end, you may always contact the data controller of our society's web site using the email address info@foerderkreis-kenya-freudenstadt.de or by sending mail to the postal address given in section 1.2 above.

6.5 Copyright of Images, Graphical Representation, Video Sequences, etc.

Unless otherwise specified, all images, graphical representations, and video sequences have been taken, or generated by members of the society which is also holding the copyright to all content thus displayed. In case we published an image erroneously depicting you as a person, for example in the background of the image, and if you wish the image to be removed from our website, you have always the right to contact us and demand the deletion of the image.

7 Future Modification of the Society's Privacy Policy

This privacy policy page may change from time to time in line with legislation developments and possible changes of our society's privacy policy. We will not explicitly inform our visitors, sponsors, members, or other web site users, of these changes. Instead, we recommend that you check this page occasionally for any policy changes.
